1. Acceptance of Terms

By accessing or using the roasOS platform ("Service"), operated by roasOS inc. ("roasOS", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Account Responsibilities

You are responsible for maintaining the security of your account and for all activity that occurs under your account. You agree to:

• Provide accurate and complete information when creating your account.
• Keep your login credentials secure and not share them with others.
• Notify us immediately if you suspect unauthorized access to your account.
• Be at least 13 years of age to use the Service.

3. Acceptable Use

You agree not to use roasOS to create, upload, or distribute content that:

• Is illegal under applicable law or promotes illegal activity.
• Depicts real individuals in a deceptive or misleading manner without their consent (e.g. deepfakes).
• Contains, promotes, or facilitates child sexual abuse material (CSAM) in any form.
• Infringes on the intellectual property rights of others.
• Contains malware, viruses, or other harmful code.
• Harasses, threatens, or incites violence against any individual or group.

We reserve the right to remove content and suspend or terminate accounts that violate these guidelines without prior notice.

4. Intellectual Property

Your content: You retain ownership of content you create using roasOS, subject to the licenses of the underlying AI models used to generate that content. You are responsible for ensuring your use of generated content complies with applicable laws.

Our platform: The roasOS platform, including its design, code, branding, and documentation, is owned by roasOS inc. and protected by intellectual property laws. You may not copy, modify, or distribute any part of the platform without our written consent.

5. Credits and Billing

• roasOS operates on a credit-based system. Credits are consumed when you generate content using the platform.
• Credits do not roll over between billing periods. Unused credits expire at the end of each billing cycle.
• Subscription fees are billed in advance on a recurring basis. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period.
• Refunds: We generally do not offer refunds for partial billing periods or unused credits. If you believe you were charged in error, contact us at support@roasos.com and we will review your case.

6. Service Availability

We strive to keep roasOS available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service is provided on an "as is" and "as available" basis. We do not offer service-level agreements (SLAs) and reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

7. Limitation of Liability

To the maximum extent permitted by law, roasOS inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of or inability to use the Service. Our total liability for any claim arising from these terms or the Service shall not exceed the amount you paid to roasOS in the 12 months preceding the claim.

8. Termination

We may suspend or terminate your account at our discretion if we believe you have violated these Terms. You may delete your account at any time through the platform settings. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) will remain in effect.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts located in Delaware.
