Terms of Service

1. Acceptance of Terms

By accessing or using the roasOS platform ("Service"), operated by roasOS inc. ("roasOS", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Account Responsibilities

You are responsible for maintaining the security of your account and for all activity that occurs under your account. You agree to:

• Provide accurate and complete information when creating your account.
• Keep your login credentials secure and not share them with others.
• Notify us immediately if you suspect unauthorized access to your account.
• Be at least 13 years of age to use the Service.

3. Acceptable Use

You agree not to use roasOS to create, upload, or distribute content that:

• Is illegal under applicable law or promotes illegal activity.
• Depicts real individuals in a deceptive or misleading manner without their consent (e.g. deepfakes).
• Contains, promotes, or facilitates child sexual abuse material (CSAM) in any form.
• Infringes on the intellectual property rights of others.
• Contains malware, viruses, or other harmful code.
• Harasses, threatens, or incites violence against any individual or group.

We reserve the right to remove content and suspend or terminate accounts that violate these guidelines without prior notice.

4. Intellectual Property

Your content: You retain ownership of content you create using roasOS, subject to the licenses of the underlying AI models used to generate that content. You are responsible for ensuring your use of generated content complies with applicable laws.

Our platform: The roasOS platform, including its design, code, branding, and documentation, is owned by roasOS inc. and protected by intellectual property laws. You may not copy, modify, or distribute any part of the platform without our written consent.

5. AI-Generated Content and Advertising

roasOS generates images, video, voices, music and copy with artificial intelligence. When you publish that content, as an ad or otherwise, you are the advertiser and you are responsible for it. You agree to:

• Make only claims about your product that are true and that you can support. Generated scripts and captions can be wrong; review them before you publish.
• Not present AI-generated people, reviews or testimonials as real customers or real experiences. Laws such as the US Federal Trade Commission rule on fake reviews and testimonials apply to AI-generated content.
• Label content as AI-generated where an advertising platform or the law requires it (for example Meta and TikTok AI labels).
• Follow the advertising policies of every platform where you publish.

6. Likeness, Voice and Reference Media

• Upload photos, video or voice recordings of a real person only if you have that person's permission to use their likeness or voice in the way you intend, including in ads.
• Clone a voice only with the documented consent of the person whose voice it is.
• Do not use roasOS to impersonate a real person, a public figure or another brand, or to imply an endorsement that does not exist.
• Upload product images, logos and reference ads only if you have the right to use them. When you remix an ad from the Discover library, the new ad must feature your own product and brand.

We may refuse, remove or stop generating content that appears to break these rules, and we may ask you to show consent.

7. API, MCP and Automated Agents

• API keys and connected agents (for example through our MCP server) act on your account. Everything done with your keys, including by an AI agent, is your activity and uses your credits.
• Keep your keys secret. Revoke a key in Settings if you think it has been exposed. Spend limits you set on a key are a safeguard, not a guarantee.
• Do not use the API to resell roasOS as a competing service, to exceed published rate limits, or to extract data from the platform in bulk.

8. Credits and Billing

• roasOS operates on a credit-based system. Credits are consumed when you generate content using the platform.
• Rollover: unused plan credits roll over for one billing cycle, up to one month's allowance, while your subscription is active. Rolled-over credits end when the subscription ends.
• Subscription fees are billed in advance on a recurring basis. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period.
• Refunds: We generally do not offer refunds for partial billing periods or unused credits. If you believe you were charged in error, contact us at support@roasos.com and we will review your case.

9. Service Availability

We strive to keep roasOS available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service is provided on an "as is" and "as available" basis. We do not offer service-level agreements (SLAs) and reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

10. Limitation of Liability

To the maximum extent permitted by law, roasOS inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of or inability to use the Service. Our total liability for any claim arising from these terms or the Service shall not exceed the amount you paid to roasOS in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your account at our discretion if we believe you have violated these Terms. You may delete your account at any time through the platform settings. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) will remain in effect.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts located in Delaware.
